AWD implementation regulations published

Jenrick IT has just been informed, by The Recruiter, that the Agency Workers Regulations, which implement the Agency Workers Directive, have now been published. The first public view of the regulations have now been uploaded to the Office of Public Sector Information (OPSI) website.

The Regulations confirm that implementation will not begin until after 1 October 2011. (more…)

Contractor umbrella companies and their contractors sent fresh warning from HMRC

Umbrella company contractors could be in line for further flak from the taxman if they find themselves in the ‘crossfire’ between their umbrellas and the taxman. Contractors are even being encouraged to ‘shop’ their umbrella companies over things like being too free and easy with their expenses dispensations.

HMRC has just released a briefing – Revenue & Customs Brief 50/09 – in which it unambiguously announces its intention to step up investigations of what it perceives as abuses of expenses and dispensation rules by umbrella companies. (more…)

Dragonfly case will have ‘no massive impact’ for contractors

After the initial shock of the news that Jonathan Bessell of Dragonfly Consulting had lost his IR35 appeal in the High Court and now faces a £99,000 tax bill, it would appear that the judgement does not place tens of thousand of contractors at risk of being inside IR35, as originally feared. (more…)
